Terms and Conditions - Concierge Services


These terms and conditions ("Agreement") outline the terms and conditions governing the provision of concierge services ("Services") under the label ‘Gatsby - The Concierge’ by Century Real Estate Holdings Private Limited ("Company") to customers ("Customers") who have booked either an Apartment or Plot in one of the Company’s projects and reside in Bangalore ("Service Area"). The Services may also be extended to “Tenants” who might be staying in the Apartments owned by Customers in the Service Area. The Customers and Tenants may collectively be called “Residents” from hereon. By availing these Services, the Residents agree to be bound by the terms and conditions set forth herein.

  1. Scope of Services:

    1. The Company agrees to facilitate a wide range of Services to the Residents within the Service Area, subject to the restrictions mentioned in this Agreement.
    2. Based on the nature of the Service offered, the Company shall recommend third party service companies (“Partners”) who in turn will fulfill the Service to the Residents.
    3. The Services facilitated by the Company may include, but are not limited to, the recommendation of various Partners who will be in charge of offering and executing different services such as transportation, booking reservations, event planning, personal shopping, home maintenance, travel assistance, and / or any other legal services as may be requested by the Residents.
    4. Company will not be liable for any unforeseen delay/deficiency/defect in any product or services disbursed by the Partner or on account of any dispute relating to the rights to utilize the product or services subsequent to disbursement of the product or service.
  2. Service Availability:

    1. The Company's working hours for providing the Services range from Monday to Saturday between 10 AM and 7 PM IST.
    2. If a service request is made by a Resident between working hours, the execution of the service may take place on any weekday, including Sunday.
  3. Service Limitations:

    1. The Company will only offer Services that are legal and ethical within the Service Area.
    2. The Company reserves the right to refuse any service request that is illegal, violates ethical standards, or poses a risk to the Company, its employees, or any third parties.
    3. The Company may refuse to provide a service that requires specialized skills or expertise beyond the Company's capacity or if the service category is not mentioned in the website.
  4. Service Request and Execution:

    1. Residents shall submit their service requests to the Company through the designated channels, including phone, email, or the website.
    2. The Company will make reasonable efforts to fulfill the requested services in a timely manner, taking into account the availability of resources and external factors beyond its control.
    3. The Company will communicate the estimated timeline for service execution to the Residents and make best efforts to meet the agreed-upon deadlines. However, the Company does not guarantee specific delivery times and shall not be held liable for any delays.
  5. Fees and Payments:

    1. The fee structure for the Services shall be communicated to the Residents upon request either by the Company or the Partner.
    2. All costs, charges, incidental expenses, duties and other applicable taxes if any, arising out of the transaction of the Service provided shall be borne by the Residents and/or the Tenant unless mentioned otherwise.
    3. Residents shall be responsible for timely payments as per the agreed-upon terms to the Company or the Partner.
    4. The Company reserves the right to revise its fee structure and payment terms upon providing reasonable notice to the Residents.
  6. Limitation of Liability:

    1. The Company shall not be held liable for any damages, losses, or liabilities arising from the use or inability to use the Services or any third-party services arranged by the Company.
    2. The Company shall not be responsible for any actions, omissions, or negligence of third-party service providers recommended or engaged by the Company on behalf of the Residents.
    3. The Residents acknowledges that the Company acts as an intermediary and that any contracts or agreements entered into with third-party service providers are between the Residents and the respective service provider.
  7. Confidentiality and Data Protection:

    1. The Company agrees to treat all information provided by the Residents as confidential and will not disclose it to any third party without the Resident’s prior consent, except as required by law.
    2. The Company will handle Resident data in accordance with applicable privacy laws and its privacy policy.
  8. Termination:

    1. Either party may terminate a Service request by providing a written notice to the other party.
    2. Upon termination, the Resident shall be responsible for any outstanding fees owed to the Company for services rendered prior to termination.
  9. Governing Law and Jurisdiction:

    1. These terms of Services shall be governed by and construed in accordance with the laws of Karnataka, India.
    2. Any disputes arising out of or in connection with the Services offered shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
  10. Acceptance:

    1. By using this website and its information, you irrevocably and unconditionally accept and agree to be bound by the terms. The Company reserves the right to change, add or remove any information presented on this website without notice. Your continued use of this website following the posting of such changes means that you accept such changes.

By availing the Services, the Resident acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
